The EU battery law phases its duties in from 2024 to 2036

The signal

The EU's Batteries Regulation, (EU) 2023/1542, an energy-sector rule covering the full life cycle of batteries, entered into force on 17 August 2023, twenty days after its publication in the Official Journal on 28 July 2023, confirmed separately by the European Commission's environment page. Entry into force is not the same as application: the regulation's own Article 96 sets general application from 18 February 2024, then lists specific provisions that apply on later dates of their own.

The evidence

The staggered dates are the substance of the story. Conformity-assessment rules and obligations on manufacturers, importers and distributors (Article 17 and Chapter VI) apply from 18 August 2024. Waste-battery management duties, covering collection and recycling (Chapter VIII), apply from 18 August 2025, the specific obligation that turns a legal text into a demand signal for recyclers, since it is the date collection and treatment requirements for producers actually start. Carbon-footprint declarations for electric-vehicle batteries are due from 18 February 2025, or later if the Commission's supporting methodology is delayed, since the regulation ties that date to a delegated and an implementing act the Commission must first adopt. Minimum recycled-content shares for cobalt, lead, lithium and nickel apply from 18 August 2031 (16%, 85%, 6% and 6% respectively), rising further from 18 August 2036 (26%, 85%, 12% and 15%). A digital “battery passport” recording model and individual battery information becomes mandatory from 18 February 2027 for larger industrial, light-transport and electric-vehicle batteries. The Commission's environment page separately confirms a related implementing measure, new rules for calculating recycling efficiency, entering into force 24 July 2025, as retrieved 16 September 2026, showing the regulation continues to generate secondary rulemaking years after its own entry into force.

Timeframe and confidence

Confidence in the fixed calendar dates, entry into force, general application, and the specific 2024, 2025, 2027, 2031 and 2036 dates, is high, since all come directly from the regulation's own Article 96 and related articles. Confidence is lower for any date the text conditions on a future Commission act “whichever is the latest,” such as the carbon-footprint declaration dates, since those could slip if the Commission's own delegated or implementing acts are delayed.

What would change the reading

Confirmation that the Commission adopted its carbon-footprint methodology by its own internal deadlines, due by 18 February 2024 for electric-vehicle batteries under the text, would show the conditional dates are on schedule rather than slipping.

• Did the Commission adopt the carbon-footprint delegated and implementing acts on the schedule the regulation sets for itself?
• What recycled-content availability exists today for cobalt, lithium and nickel against the 2031 minimum shares?
• Will the digital battery passport's 2027 start date hold, or does it depend on further technical specifications not yet adopted?

A single entry-into-force date obscures more than it reveals here: the regulation's real effect arrives in stages across thirteen years, and each stage is a separate, independently checkable deadline rather than one moment of change.
