Within Signal Atlas's 04 Cybersecurity sector, one date recurs across a decade of privacy and platform-compliance stories: 25 May 2018. The General Data Protection Regulation, formally Regulation (EU) 2016/679, was adopted by the European Parliament and Council on 27 April 2016 and set 25 May 2018, roughly two years later, as its date of application — a gap the regulation itself built in for organisations to prepare, distinct from its earlier entry into force. Its recitals state that the regulation applies to a controller or processor not established in the EU when their processing activities relate to offering goods or services to people in the EU, or to monitoring their behaviour there, the extraterritorial reach that later commentary treated as the regulation's defining feature.
The evidence
Adoption is when a law is agreed; application is when it starts being enforced against ordinary conduct. A European Commission communication published 24 June 2020, evaluating the regulation's first two years of application, states that between 25 May 2018 and 31 December 2019, 141 draft decisions were submitted through the cross-border "one-stop-shop" cooperation procedure among national regulators, of which 79 resulted in final decisions. The same communication describes enforcement fines as "ranging from a few thousand euros to several million," without giving a running total — a level of precision the Commission itself chose not to exceed at that stage, two years in. The UK's Information Commissioner's Office, the country's supervisory authority, lists monetary penalties and enforcement notices under an ongoing enforcement-action function on its website, as retrieved on 16 September 2026, though a specific post-2018 case count sits behind a search tool this review could not query.
Timeframe and confidence
This is an editorial reading: the application date and the extraterritorial-scope language are directly stated in the regulation's own text, so confidence in the mechanism is high. Confidence in any specific enforcement total is lower, because the Commission's own two-year review deliberately gave only a range rather than an aggregate figure, and because enforcement data is generated and published separately by each national authority rather than in one central register.
What would change the reading
A later Commission review publishing a specific aggregate fine total and complaint count, comparable across the full period since 2018, would sharpen this picture considerably; continued reliance on ranges and one-off national figures would suggest the fragmented-enforcement pattern the 2020 review described has persisted.
- Is a regulation's application date being confused with its adoption date or its entry-into-force date?
- Does a cited enforcement figure come from one national authority, or an EU-wide aggregate?
- What does an extraterritorial-reach clause actually require of an organisation with no EU establishment?
The application date mattered less as a single moment of change than as a hinge: data practices involving EU residents before 25 May 2018 were governed by a patchwork of national laws implementing an older directive, and practices after it were measured against one directly applicable, EU-wide text.
